1. Who we are and these terms
My Asset Safe (the "Service") is operated by My Asset Safe Ltd ("My Asset Safe", "MAS", "we", "us", or "our"), a company registered in England and Wales under company number 17483872, with its registered office at 76 Glebe Lane, Barming, Maidstone, Kent, ME16 9BD.
These Terms of Service (the "Terms") form a binding agreement between you and us and govern your use of the Service. By creating an account, starting a free trial, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.
Please read these Terms together with our Privacy Policy and Cookie Policy, which form part of these Terms.

3. Eligibility
To use the Service you must:
- Be at least 18 years old.
- Be resident in the United Kingdom.
- Have the legal capacity to enter into a binding contract.
- Not be barred from using the Service under any applicable law.
The Service is intended for personal, non-commercial use by individuals.
4. The Service: what My Asset Safe does
My Asset Safe is a secure digital vault that helps you record and organise information about your estate in one place. You can record assets and liabilities across a range of categories (for example bank accounts, pensions, ISAs, investments, property, life assurance, cash, personal belongings, mortgages, loans, and credit cards), along with supporting documents and notes.
While you are alive, your Vault is private to you and is locked to others unless you choose to share it: you may give a Nominated Person a read-only view of your live Vault once you have confirmed their identity, and you may withdraw that access at any time (see section 8). After your death, an individual you have named may request access through the Death Claim process described in section 8. Access is never automatic: it is granted only after the relevant checks, it is read-only, and it is time-limited.
The Service is offered directly to individuals and may in future be offered through partner organisations such as UK banks and wealth managers. We do not currently promise or provide any third party integrations, and the availability of any future partner features is not guaranteed.
5. My Asset Safe is not a will or professional advice
My Asset Safe is a private record keeping and estate organisation tool. It is not, and must not be treated as:
- a will, codicil, trust, lasting power of attorney, or any other legal instrument;
- financial, investment, tax, accounting, or legal advice; or
- a substitute for professional advice from a qualified solicitor, financial adviser, or accountant.
Recording information in your Vault has no legal effect on how your estate is distributed. It does not transfer ownership of any asset, create any trust, or override the terms of a valid will or the rules of intestacy. You should still make and maintain a valid will and take professional advice where appropriate. You are responsible for the accuracy and completeness of the information you record.
6. Your account: registration and security
You must provide accurate information when you register and keep it up to date. You are responsible for keeping your sign-in credentials confidential and for all activity that takes place under your account.
Access to the Service is protected by sign-in through Amazon Cognito. We strongly recommend that you enable multi-factor authentication (MFA), which is available using an authenticator app (TOTP) or SMS. MFA is optional and you may choose to opt out, but opting out reduces the security of your account, and we recommend keeping it switched on.
Because of the way your Vault is encrypted (see section 7), the ways in which access can be recovered are deliberately limited. There is no separate vault password to reset. If you lose your sign-in credentials or your authenticator device, you must use the account recovery process we provide (for example by contacting support), which may require additional identity checks. Please keep your credentials, recovery details, and authenticator device safe.
7. How your data is protected: encryption and recovery
We use envelope encryption to protect your Vault. When your Vault is created, a unique Vault Key (your User Master Key) is generated for you. Your records are encrypted using AES-256-GCM before they are sent to us, and the encrypted data is stored in the United Kingdom (Amazon Web Services, London region). There is no separate vault password: your Vault Key is wrapped (encrypted) on our servers using AWS Key Management Service (KMS) and released to you only after you sign in and complete authentication.
My Asset Safe is not a "zero knowledge" service. To support account recovery and the Death Claim process, we keep a strictly controlled ability to unlock your Vault Key through an audited key management path. This capability is limited to two tightly restricted internal roles (one for routine key release to you, and one for approved death unlocks), and its use is logged. Our staff cannot browse or read your Vault data through the ordinary application. We treat this as a deliberate trade-off that makes recovery and lawful release to your Nominated People possible.
8. Nominated Access and the Death Claim process
You may name up to five Nominated People who may be given access to your Vault after your death. You may also choose, while you are alive, to give a Nominated Person a read-only view of your live Vault once you have confirmed their identity. That access is yours to grant and yours to withdraw at any time, and nothing is shared unless you turn it on. Where you have not granted access yourself, it is granted only through the Death Claim process, and only after the relevant checks are completed.
We do not ask for a death certificate. Instead, when a Nominated Person reports your death, every Nominated Person is individually asked to confirm it, signed in to their own account with multi-factor authentication and with their identity already verified by you. Nothing is released until every Nominated Person has confirmed, or has been set aside by our support team on evidence that they have died, lack capacity, or cannot be reached.
Once everyone has confirmed, you are given a response window of your own choosing (between 14 and 28 days) before anything is released. We contact you repeatedly during that window, and you can stop the release at any time with a single tap, or simply by signing in. If you object or sign in during that window, the request is cancelled and no access is granted.
If you do not respond within the window, access is granted to the Nominated People you marked as Primary. Nominated People you marked as Secondary must also confirm your death. They receive access only if you ticked Backup access for them and none of your Primary Nominated People are able to act; Secondary Nominated People without Backup access never receive access.
Access granted to a Nominated Person is read-only and time-limited. The process is designed to protect against fraud and error, and it may take time to complete, particularly if a Nominated Person does not confirm promptly. We are not responsible for delays caused by a Nominated Person failing to confirm, or by checks required to confirm a death. Records relating to a Death Claim are retained for 7 years, as set out in our Privacy Policy.
Keeping your Nominated People up to date, including removing anyone who has died or should no longer have access, is your responsibility. Because every Nominated Person must confirm before access is released, a Nominated Person you can no longer reach, or who no longer wishes to act, can delay access being granted to anyone. We do not check whether a Nominated Person you have named is still the right person, still contactable, or still alive; that is for you to keep current.
9. Subscription, pricing, and free trial
The Service is provided on a paid subscription. Our current prices are £7 per month, or £75 per year (an annual plan equivalent to £6.25 per month). We also run a Friends and Family pilot from time to time. Accounts in the pilot are not charged while it runs, and we will let you know before it ends, after which the prices above apply. Prices are in pounds sterling and include any applicable VAT unless we state otherwise.
New accounts may start with a free trial of one calendar month. No payment method is required to start the trial. If you do not subscribe before the trial ends, your account access is paused until you subscribe. Once you subscribe, your chosen payment method is charged immediately and your Subscription then renews automatically (monthly or annually, depending on your plan) until you cancel.
Payments are processed by our payment provider, Stripe. We do not see or store your full card number; card details are handled by Stripe under its own terms and security standards. You authorise us, through Stripe, to charge your payment method for the fees that apply to your plan.
We may change our prices from time to time. We will give you reasonable advance notice of any price change, and it will take effect from your next renewal. If you do not accept a price change, you may cancel before it takes effect.
10. Cancellation, refunds, and your statutory rights
You can cancel your Subscription at any time through the billing portal in your account. When you cancel, your Subscription does not renew again, and you keep access until the end of the period you have already paid for. We do not provide refunds for partial billing periods unless the law requires it.
As a consumer in the UK, you normally have a statutory right to cancel a purchase of digital services within 14 days of entering into the contract (the "cooling off" period). Because the Service is supplied digitally and made available to you straight away, you may be asked to acknowledge that the Service will start during that 14 day period. If you ask us to start the Service within the cooling off period and then cancel, we may charge you for the part of the Service already provided up to the point you tell us. Once the Service has been fully provided during the cooling off period with your acknowledgement, your right to cancel may be lost. These rights are in addition to, and do not affect, your other legal rights.
11. Failed payments, suspension, and account closure
If a payment fails, we will try to take payment again and let you know. You will have a grace period of 14 days to update your payment details. If payment is still not received after the grace period, your account will be locked and you will not be able to access your Vault until payment is brought up to date.
If you cancel, or if your account stays unpaid, we keep your data for a limited period so that you can reactivate. We then permanently delete your Vault data 90 days after cancellation, in line with our Privacy Policy. Some records (for example records relating to a Death Claim, or information we must keep for legal, tax, or accounting reasons) may be retained for longer, as described in the Privacy Policy.
12. Acceptable use
You must not:
- Use the Service to store or share content that is unlawful, obscene, or that infringes the rights of others.
- Attempt to gain unauthorised access to other accounts or to our systems.
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Service, except where the law allows.
- Use automated means to interact with the Service, except through interfaces we explicitly provide.
- Impersonate another person, or misrepresent your identity or your relationship to a Nominated Person.
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.
Breaking these rules may lead to immediate suspension or termination of your account.
13. Your content and the licence you grant us
You keep all rights in the Content you store in your Vault. To provide the Service, you grant us a limited, non-exclusive, royalty-free licence to host, store, encrypt, back up, transmit, and process your Content, and to make it available to your Nominated People through the Death Claim process, solely to operate and provide the Service to you. This licence ends when your Content is deleted from our systems, except to the extent we are required to keep it by law.
You are responsible for your Content. You confirm that you have the right to store it and that it does not break the law or infringe anyone else's rights.
14. Our intellectual property
The Service, including its software, design, text, graphics, and branding, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the Service for its intended purpose. You must not copy, modify, distribute, sell, or create derivative works from any part of the Service except as the law allows.
15. Data protection and privacy
We process personal data in accordance with UK data protection law and our Privacy Policy, which explains what we collect, how we use it, how long we keep it, and your rights. Our Privacy Policy forms part of these Terms.
16. Third party services
The Service relies on trusted third parties, including Amazon Web Services (hosting and key management, London region) and Stripe (payment processing). Your use of those services through the Service may also be subject to their own terms. We choose our providers carefully, but we are not responsible for the acts or omissions of third parties that are beyond our reasonable control.
17. Service availability
We work hard to keep the Service available and secure, but we do not promise that it will be uninterrupted, error free, or always available. We may suspend the Service for maintenance, updates, or security reasons. Except for the rights and warranties the law gives you and that cannot be excluded, the Service is provided on an "as is" and "as available" basis.
18. Limitation of liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be limited or excluded under English law, including your rights under the Consumer Rights Act 2015.
Subject to the paragraph above, and to the fullest extent permitted by law:
- we are not liable for losses that were not reasonably foreseeable, for business losses (such as loss of profit, as the Service is for personal use), or for loss or damage caused by your own failure to keep your credentials secure or your information accurate; and
- our total liability to you for all claims arising in connection with the Service in any 12 month period is limited to the total Subscription fees you paid to us in that period.
We are not responsible for the underlying value, performance, or existence of any asset you record. The Service is a record of information you provide; it is not a custodian of your assets.
19. Indemnity
You agree to cover reasonable losses, damages, and costs we suffer that are caused by your breach of these Terms or your unlawful use of the Service, except to the extent they are caused by us. Nothing in this section requires anything of you that cannot lawfully be required of a consumer.
20. Suspension and termination
You may close your account at any time. We may suspend or end your access to the Service if you seriously or repeatedly break these Terms, if we are required to by law, or if your account remains unpaid. If we decide to stop offering the Service altogether, we will give you reasonable notice (at least 90 days where practical) so that you can make a record of your information before access ends.
21. Changes to the Service and to these terms
We may update the Service and these Terms from time to time, for example to reflect new features, legal requirements, or changes to how the Service works. If we make a material change to these Terms, we will give you reasonable notice by email or through the Service before it takes effect. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not accept them, you may cancel.
22. Governing law and jurisdiction
These Terms, and any dispute arising from or in connection with them, are governed by the law of England and Wales. You and we agree that the courts of England and Wales have jurisdiction, although if you live in another part of the United Kingdom you may also be able to bring proceedings in your local courts.
23. Complaints and how to contact us
If you have a question or a complaint, please contact us first so we can try to put things right. You can reach our support team at support@myassetsafe.com and our legal team at legal@myassetsafe.com.
